California Electronic Waste Recycling Act
Regulatory Workshop: January 5, 2006
As the
Electronic Waste Recycling Act of 2003
(SB 20
and SB 50, Sher) is
implemented, workshops will be held to inform
affected stakeholders and other interested parties.The California Department of Resources Recycling and Recovery (CalRecycle) held a general stakeholder workshop for interested parties regarding final rulemaking on Thursday, January 5, 2006, at the Cal/EPA Headquarters Building in Sacramento. The workshop began at 9AM and lasted until about 2PM.
As provided in previous workshops, a general audio "web-cast" was available for a portion of the proceedings. Web-based participants were able to submit comments via e-mail during the event through the ewaste@calrecycle.ca.gov address.
Details:
The CIWMB is facing an accelerated timeframe for finalizing the
regulations governing the covered electronic waste (CEW) recovery and
recycling payment system. Existing
emergency regulations expire
December 13, 2006. To have final rules in place by then, the CIWMB
should adopt regulations by August 2006. To meet this deadline, the CIWMB anticipates noticing
draft regulations in February to begin the formal rulemaking process.
Interested parties may recall that the informal rulemaking process began in summer 2005 when the CIWMB held a "fact-finding" workshop to listen to stakeholders' concerns and ideas regarding the existing emergency regulations. That event led to revisions in the existing emergency regulations deemed necessary before the CIWMB moved ahead with final rulemaking. However, that revision exercise postponed work on the final regulations governing the CEW recovery and recycling payment system... and the clock is ticking.
At the January 5th workshop, program staff reviewed the calendar ahead, mapped the rulemaking process, and identified key milestones necessary for the final regulations to be adopted and approved on time. Through smaller group discussions, stakeholders were given the structured opportunity to identify areas of concern within the program and provide comments and suggestions on how and whether the final regulations should change from existing emergency regulations.

To maximize meaningful participation, stakeholders were encouraged to review applicable statutes and regulations, and to prepare specific comments prior to attending the meeting. To ensure that key issues are received, comments could be sent in advance to ewaste@calrecycle.ca.gov.
