Subject: EAC Resolutions 2002-03, 2002-04, 2002-05 and 2002-06

Dear Mr. Pirie:

Thank you for sending Enforcement Advisory Council (EAC) Resolutions 2002-03, 2002-04, 2002-05 and 2002-06, which the EAC passed at their November 14, 2002 meeting.

Resolution 2002-03

The California Integrated Waste Management Board (CIWMB) looks forward to a productive and inspiring relationship with the new EAC Chair and Co-Vice Chairs which were voted in at the November 14, 2002 EAC meeting and are identified in Resolution 2002-03.

Resolution 2002-04

Additionally, we are very pleased with the outstanding list of new LEA members for the Toolbox Maintenance Advisory Committee (TMAC), as identified in Resolution 2002-04. TMAC is an integral part of sustaining the Permit Toolbox as an effective system to provide guidance on solid waste permit requirements and permit issues. TMAC develops the priority list of maintenance tasks for the toolbox and provides support for RDSI document guidance reviews. We appreciate the EAC’s support and participation.

Resolution 2002-05

Resolution 2002-05 asks the CIWMB if an Enforcement Program Plan (EPP) Toolbox would be a viable tool to create and offers EAC’s assistance with the effort. The innovative suggestion of designing an EPP Toolbox will be explored by the LEA Support Services Branch of the Permitting and Enforcement Division. Sharon Anderson, Branch Manager, LEA Support Services, will be the contact person and will be better able to address the practicality of this new toolbox after researching the issue. An update will be provided at the EAC meeting in spring 2003. Sharon may be reached at 916-341-6400.

Resolution 2002-06

Resolution 2002-06 recommends changes to Section 17211.7, subsections (e) and (f) of the proposed regulations for Waiver of Permit Terms and Conditions During Temporary Emergencies. The changes suggested by EAC are shown below.

(e) The EA may provide an oral or written report to the Board if requested, during the next or subsequent scheduled meeting after an extension of a stipulated agreement.

(f) (Request for 24-hour notice in daily newspaper and Board’s web page should be deleted.) 

Please note, that the regulations in question were included at the specific direction of the Board. A Stipulated Agreement would allow a waiver of a term and/or condition of a solid waste facility permit (SWFP). As the Board must concur with a SWFP during a public meeting, a notice in a newspaper and publishing on the Board’s web page regarding the issuance of a Stipulated Agreement provides for public notice in lieu of a public meeting. The Board acknowledged the LEAs’ concerns regarding oral reports. However, they approved the proposed regulations without changes at the December Board meeting, and asked staff to clarify issues in the statement of reasons.
