Dear Mr. Pirie:

Thank you for sending Enforcement Advisory Council (EAC) Resolution 2003-02 which was passed at the January 30, 2003 EAC meeting.

The resolution identifies issues of concern to be addressed to further LEA/CIWMB Partnership efforts. Regulation Development was identified as the issue of highest priority concern and Permitting as the issue of second highest priority concern to LEAs. The issues were identified by EAC and CCDEH by compiling the results from a CCDEH sponsored survey sent to LEAs throughout the state.

CIWMB appreciates EAC’s acknowledgement of the successful working relationship between LEAs and CIWMB in many areas. CIWMB recognizes the need for continual discussion, evaluation and improvement of the CIWMB and LEA working relationship, which is evidenced by our creation, support and nurturing of Partnership efforts.

Resolution 2003-02 requests that the CIWMB accomplish the following:

  • Review and consider the two Issue Statements for 1) Permitting, and 2) Regulation Development.
  • Prepare an Issue Statement identifying CIWMB needs that the LEAs or Partnership Workgroup can address,
  • Recommend a means of reconvening or implementing a new Partnership Workgroup comprised of EAC Member (s), CIWMB Staff/Management, and CCDEH-SWPC Member (s).

Currently, CIWMB staff is reviewing the Issues identified in Resolution 2003-02. At the LEA/CIWMB 2002 Conference Partnership Session, CIWMB agreed with LEAs that there are issues to be resolved regarding Regulation Development and Permitting. Additionally, CIWMB identified our priority concerns regarding inspections and enforcement actions. The CIWMB Issue Statement is still being refined, and the new Partnership Working Group is being developed. CIWMB staff are currently in the process of identifying staff to be involved in the Partnership Working Group. We hope to bring a list of potential candidates to the next EAC meeting in March.

The CIWMB looks forward to working with EAC and CCDEH to enhance our Partnership and to continue to maximize our success at protecting public health and safety and the environment.
