Dear Mr. Levenson:

The Enforcement Advisory Council (EAC) met on June 19, 2003 and passed Resolution 2003-04. The Resolution requests that a task group of LEA and CIWMB staff evaluate the five-year permit review process. A critical component of this evaluation is to determine how changes can be made to a solid waste facility permit without requiring a full permit revision. The EAC feels that the purpose of the five-year review is to update all information that is in the permit such as if additional environmental review that had been conducted in the last five years or date of last revised Report of Disposal Site Information. Many of these changes are informational in nature and should not require Board concurrence. At this time any changes to the solid waste permit requires CIWMB concurrence. We also understand that the CIWMB is in the process of developing a new Partnership Working Group and permitting has been identified by CCDEH as second highest priority concern of LEAs. We ask that as part of this new Partnership Working Group that a component would contain evaluation of the five-year review process.
