Subject: Enforcement Advisory Council Resolution 2005-03--Recommendations Concerning Title 27, Subchapter 4, Article 6, Gas Monitoring and Control at Active and Closed Disposal Sites

Dear Mr. Levenson:

The Enforcement Advisory Council (EAC) met on March 8, 2005 and passed Resolution 2005-03. The resolution requests that the California Integrated Waste Management Board (CIWMB), in partnership with the EAC, review and draft regulatory changes to the existing regulations for gas monitoring and control at active and closed disposal sites in Title 27 of the California Code of Regulations (CCR).

In 2003 the CIWMB formed a technical advisory group of stakeholders to perform two tasks. Task one was to develop regulations that addressed revising permits for landfills with long-term landfill gas violations and task two was to review all existing landfill gas regulations to determine adequacy and the need for revisions. For task two it is our understanding that the technical advisory group felt that there was definitely a need to revise the existing regulations for gas monitoring and control at active and closed disposal sites.

The EAC is in agreement with the technical advisory group that the existing regulations in Title 27 Sections 20918–20937 be revised. Landfill gas is a significant public safety threat, especially at closed sites where there is no preexisting gas control system and where encroaching development is at the landfill property boundary. We ask that the original technical advisory group continue with task two and that the EAC be involved in the development of the revised regulations.
