Subject: Response to EAC Resolution 2006-01–Electronic Data Reporting, Document Submittal and File Storage

Dear Mr. Prinz:

This letter is in response to Enforcement Advisory Council (EAC) Resolution 2006-01, dated April 12, 2006 which was passed at the March 7, 2006 EAC meeting.

The EAC resolution requests that the CIWMB consider accepting electronic transmittal and storage of data and documents, including permit documents, which the LEAs send to the CIWMB. As background, the EAC and LEAs suggest that electronic data reporting and electronic document submittal would help with overall data management and data storage and will reduce the amount of paper files needed to be housed by both entities.

This is a timely request, as we have been discussing this issue with our Information Management Branch (IMB). Based on these preliminary discussions, IMB is considering the development of a File Transfer Protocol specification that will allow those LEAs that are already capturing inspection data to report that electronically in lieu of hard copy reports. The process and code for electronic data transfer for inspection data seems to be a prime candidate for leveraging similar work that IMB has already performed for the Board’s Waste Tire Manifest System. As part of the development work, we would probably want to run a test case with an LEA who has the technological capabilities and is currently capturing and storing data electronically. We also will have to examine any regulatory restrictions or allowances.

As a result of the EAC’s interest in this issue, I will be meeting with IMB management to discuss the potential scope and timing of such a project. It is also my understanding that at the April 19, 2006 meeting, the EAC passed a different resolution asking CIWMB staff to participate in a task force regarding record retention. We look forward to receiving the new resolution.

CIWMB staff will keep the EAC and LEAs appraised as we discover the means to meet this request and will seek input as needed during our research. Bernie Vlach will act as the primary contact for this assignment, so feel free to contact him at 916-341-6320.
