II. Agenda Review:

IItems to be discussed on agenda will be facilitated by availability of presenter throughout the day.

III. Approval of Previous Minutes:

A motion was made and seconded (Pirie/Lafreniere) to approve the minutes from the June18, 2008, EAC meeting. The minutes were approved by a unanimous vote.

IV. EAC Resolutions--Status and Updates:

  • Resolution 2007-02--Permit Application Form and Instructions, Subcommittee Update, Mary Madison-Johnson: No new developments on this item. Staff is awaiting Board response on the proposed changes discussed during the workshop and will how it will address questions like "peak tonnage."
  • Resolution 2007-05--Closed Sites with Multiple Owners, Subcommittee Update, Bill Orr/Leonard Grossberg: No follow up yet on the multiple owner resolution. Glen Young had been called out on Military Reserves and has not been available to prepare Board staff response.
  • Resolution 2006-01--E-filing Data and SWIS Accessibility, Bonnie Cornwall: California Conference of Directors of Environmental Health (CCDEH) would be hosting a data summit on August 22, 2008. The “schema” for meshing local systems with CIWMB’s should be available for testing in mid-September

V. EAC Discussion Items:

A. Pharms and Sharps Program Implementation, (Jim Cropper):

AB 1305 on home generated sharps goes into effect on September 1, 2008. Mr. Cropper discussed various local models to receive back pharms to address concerns about drugs being introduced to surface and groundwater. The best management practices (BMPs) are to be developed for collection of pharms.

Efforts being made to address illegal disposal of home generated sharps in landfills. Public educational outreach is currently addressing issue. Approximately 500 locations in state receive sharps from public. Goal is to have 1,000. Wide variety of systems used in local programs. List server information is available.

B. Landfill Gas Regulations at active Landfills, Ted Rauh:

PowerPoints from recent Board Meetings re: regulations are available online as well as a scheduled Webinar (September 8 or 9) to address CIWMB expectations for plans submitted for LEA approval and CIWMB concurrence. The SCS Probe Study has been the seed for new BMPs for landfill gas probe design and CIWMB will be seeking general comments.

An extension will be granted for operators to submit compliance plans and implementation of new landfill gas monitoring probe requirements. LEA enforcement strategies were discussed including allowing for areas of concern to be issued to operators that submit plans to the LEA on or before September 21, 2008.

There was also a discussion regarding concurrent submittal by an operator to the LEA and CIWMB to expedite review. All plans require LEA approval prior to CIWMB concurrence with strict regulatory interpretation. Alternatives would require strong geological and hydro-geological support to gain compliance status.

VI. CIWMB Topics, Updates and Discussion:

A. Legislation/Regulations, Bob Holmes: Review of current legislation:

  • AB 2695: Illegal dumping – killed for the year (Niello)
  • AB 2679: Enhanced enforcement. Removes auto stay. (Ruskin).
  • AB 2866 Tipping fee increase to $2.00; divert organics--suspended (DeLeon)
  • AB 2640: Tipping fee increase; green waste diversion--held up (Huffman)
  • SB 1016: Diversion to disposal; moving towards passage (Wiggins)
  • SB 1020: Increasing diversion to 75 percent--held up (Padilla)

Regulations-Watching and waiting on several items in the works:

  • Waste tire hauler manifesting changes: Formal process is moving forward.
  • Long term post closure care package

B. Long-Term Financial Assurance, Bill Orr:

Board to initiate formal rulemaking-to go public for 45-day comment period.

C. Multiple-Owner Resolution, Bill Orr:

No follow up prepared due to Glenn Young being absent with military reserves.

D. AB 32-Green House Gases at Landfills, Stephanie Young:

Reduce overall green house gas (GHG) emissions to 1990 levels by 2020 statewide.

The CIWMB's climate action team submitted 8 strategies for reduction of GHG. Increase control and capture of landfill methane.

Reduce surface emissions from 500 ppm to 200 ppm.

CIWMB funding of projects to convert LFG to LNG.

E. Training and LEA Conference, Loretta Sylve/Melissa Hoover-Hartwick:

CIWMB/LEA conference in Napa. No trade show this year. Field trips to local facilities. Duane Woods, Waste Management, Inc. is keynote speaker.

F. Ralph Hunter Award, Trey Strickland:

Nominations to be submitted to Trey by September 19, 2008.

G. EA Grant Program, Michelle Martin:

Grant payments are frozen due to lack of state budget. Spend at your own risk until budget signed. Mary Phongmany is the new grant specialist.

H. Draft Guidance for Inspection and Enforcement of New Landfill Gas Regulations at Active Landfills, Georgianne Turner:

EAC spent a considerable amount of time reviewing and commenting on a draft guidance document for advising LEA's and operators regarding implementation of the new landfill gas monitoring regulations.
