Authorization of Local Enforcement Agencies (LEA) for Asbestos-Containing Waste (ACW) Program

I’m taking this moment to remind the LEAs about important milestones and deadlines associated with the state Asbestos-Containing Waste Program, and to get feedback from you about your ACW program authorization. I’ll need a response from some of you by January 30, 1998.

The permanent Asbestos-Containing Waste regulations became effective January 13, 1997, (after emergency regulations were adopted August 1, 1996) and facilities that handle and dispose of manifested ACW are required to be current with and meet the requirements of these regulations.

The California Integrated Waste Management Board (CIWMB) encourages all LEAs with solid waste landfills having ACW disposal units to obtain ACW authorization. The procedure for obtaining authorization is explained in LEA Advisory No. 42, which you received previously. (Don’t hesitate to request another copy or download it from the LEA Central web site.)

On or after October 30, 1996, owners and operators of ACW facilities must meet security inspection, manifest system, record keeping and reporting requirements and implement approved changes according to a schedule of compliance established by the Enforcement Agency.

On or after November 29, 1997, solid waste facilities permits for solid waste landfills with ACW disposal units have to be revised or the RDSI amended to reflect ACW handling and disposal, if not already reflected.

Below is a preliminary list of solid waste landfills in the state that include ACW disposal units. In order to verify the scope of the state ACW program I am asking that you review this list and let me know by January 30, 1998, if you are aware of any other sites that have ACW disposal units.

If you currently have jurisdiction over a solid waste landfill that includes an ACW disposal unit and haven’t previously requested ACW program authorization I would appreciate it if you would contact me and indicate your intentions. We are establishing a state permitting, inspection and enforcement program for solid waste landfills that include ACW disposal units, and we need your commitment by January 30, 1998. After that date the CIWMB will assume the role of Enforcement Agency (EA) for ACW at each solid waste landfill that accepts ACW where LEAs have not received authorization under the ACW regulations and Public Resources Code (PRC) Section 44820. As the EA the board may conduct inspections, review solid waste facility permits, issue enforcement orders and take enforcement action. The board will charge reasonable fees to facility operators to recover costs for our actions in that capacity.
