Local Enforcement Agency Correspondence Reporting of Unregistered Waste Tire Haulers |

Date: May 8, 2000 To: Solid Waste Facility Operators The California Integrated Waste Management Board (CIWMB) is requesting that your solid waste facility report any unregistered waste tire haulers (those who haul five or more waste tires per load) that are accepted by your facility, pursuant to California Code of Regulations (CCR) Title 14, Section 18461. This information provided will be utilized to ensure that all waste tire business operators comply with applicable statute and regulations. Listed below is the applicable section of law which applies to solid waste facility operators. Section 18461 Manifest System Requirements for Waste Tire Destination Sites. The Waste Tire Hauler Manifest System requires specific actions on the part of destination sites as provided in section 18461 including, but not limited to, the following. (a) The waste tire destination site may accept the waste tires from waste tire hauler(s) who are not registered with the Board and/or has no manifest. (b) The waste tire destination site shall report to the board the following information on waste tire hauler(s) who are not registered with the Board and/or has no manifest:
(c) A waste tire destination site receiving waste tires from an unregistered waste tire hauler without complying with (b) of this section subjects the waste tire destination site to civil and administrative penalties not to exceed ten thousand dollars ($10,000) for each violation. In addition, please be aware that waste tire manifests submitted to your facility by registered waste tire haulers are required to be maintained at your place of business for a duration of three (3) years. |
