Evaluation and Abatement of Burn Dumps

Since the issuance of LEA Advisory No. 56, Process for Evaluating and Remediating Burn Dump Sites, on November 4, 1998, some concerns have been raised that the contents and intent of the Advisory could be misinterpreted and/or misapplied. Therefore, a Burn Dump Work Group has been formed consisting of representatives of the California Integrated Waste Management Board (CIWMB), Department of Toxic Substances Control, State Water Resources Control Board, and Regional Water Quality Control Boards. The initial purpose of the Work Group is to determine the relevant policy, procedures, concerns, and jurisdiction of the various State agencies regarding the evaluation and remediation of burn dumps.  Since this has been determined, we plan to add Local Enforcement Agency representatives to the Work Group. Thereafter, the intent of the expanded Work Group is to prepare a revised LEA Advisory that will delineate the various agencies jurisdictions, and incorporate changes in policies and procedures since the original advisory issuance. 

In order to not unreasonably delay current burn dump remediation projects prior to revision of the Advisory, the attached clarification sheet has been prepared (in a question/answer format) to clarify some of the more critical aspects of burn dump remediation. Until LEA Advisory No. 56 is revised, the existing advisory, plus the clarification sheet, should be used together.  As always, CIWMB Remediation, Closure, and Technical Services staff are available to provide assistance if there are any questions concerning the applicability of the Advisory.
