This all LEA E-mail was sent on behalf of the LEA Support Services Branch of the California Integrated Waste Management Board and Allison Reynolds, and contains two separate updates on the following information:
- Air Resources Board Information and Fact Sheets on Residential Waste Burning
- Construction and Demolition and Inert (CDI) Transfer and Processing Regulations summary of changes
Air Resources Board Information
FYI, the Air Resources Board has begun efforts to gather input on a proposed Air Toxics Rule regarding residential waste burning. Please see the following website for more information:

CDI Transfer and Processing Regulations Update
In December 2000, the Board approved a two-phase regulatory development split for Construction and Demolition and Inert (CDI) debris operations and facilities. Phase One addresses transfer and processing operations and facilities, and Phase Two addresses disposal facilities. The latest version of the draft regulations for transfer and processing operations and facilities is attached.
Since the November Board Meeting, staff has made changes to the previous version of the draft regulations as follows:
- Deleted steel, rock, and soil from the C&D definition, section 17381 (c)
- Changed the amount of incoming tonnage allowed for CDI operations to under 300 tons per day, section 17381(e)
- Changed the amount of incoming tonnage allowed for CDI facilities to 300 tons or more per day, section 17381(d)
- Changed the amount of incoming tonnage allowed for inert debris operations to under 1500 tons per day, section 17381(j)
- Changed the amount of incoming tonnage allowed for inert debris facilities to 1500 tons or more per day, section 17381(i)

Amended language in Section 17381.1 to allow commingling of lumber and steel in a single container, section 17381.1(a)(1)(A)

Added "or reuse" to sections 17381.1(d)(1), (2), (5) and (6) and subsections (a) & (b) of sections 17383.1, 17383.3, 17383.4 and 17383.5

Storage limits for recycling centers can be extended upon EA approval, sections 17381.1(d)(5) and (e)(6)

Storage limits do not apply to Type A inert debris recycling centers that take place at a solid waste disposal facility or at a material production facility that primarily handles raw materials to produce a new product, section 17381.1(e)(3)

Added for clarity, "material is being stored in excess of the material storage limits" to section 17381.1(g)(1).

Storage limits may be extended where a conditional use permit specifies exact time limits, sections 17381.1(d)(4) & 17381.1(e)(5) and 17384(c).

Storage limits may be extended where financial assurance requirements are met, sections 17381.1(d)(3) & (e)(4) for recycling centers and 17382.1, 17383.1(d), 17383.3(d), 17383.4(d) & 17383.5(d) for operations and facilities

Added "flood control work" to section 17382(a)(2) and "Grading activities ..." to Section 17382 (a)(3) Excluded Activities

Added language to aid the EA in determining if storage limits are exceeded. See sections, 17383.1(d), 17383.3(c), 17383.4, (c) and 17383.5(c).

Changed storage limits for inert materials to 6 months for unprocessed material and 18 months for processed materials see sections 17383.4(a) & (b) and 17383.5 (a) & (b)

In Section 17384, added a description of a storage plan to aid the EA in making a storage limit extension
- Added "and the board" to Approval of Alternatives section 17384(a)
- Added "or as determined by the EA" to section 17383.2(c)(3)

Added Section 17384.1 for Final Site Cleanup

Added a Construction and Demolition/Inert Debris Operation Plan requirement for CDI processing operations or inert debris processing operations, section 17386.

Added a new form (form number to be supplied) for a Clean Up Plan as required in section 17382.1(b) for those sites requesting a financial assurance mechanism.
