Permitting and Enforcement (P&E) Committee
Meeting: Monday, December 2, 2002
Board Meeting: December 10 & 11, 2002
Board and P&E Committee Meeting Summary:
- The Board voted
unanimously to adopt the proposed regulations for The Waiver Of Terms And
Conditions During Temporary Emergencies and its Negative Declaration.
- The Board directed
staff to begin another 15-day comment period for the proposed Construction and
Demolition and Inert Debris Processing Tiered Regulations (Phase I). After
much discussion, the Board chair directed staff to include language that
will establish a Registration Tier permit for facilities that process 50-300
TPD of C&D debris with no more than 20% residuals. Additionally, the
regulations should allow a temporary Registration Tier permit while a full tier
permit is being obtained for facilities that process over 300 TPD of C&D
debris or have more than 20% residuals. A facility may process only 50 TPD but
if they are over 20% residual they will need a full SWFP. Also, the changes will
include two definitions, one for "debris" and another for "waste". A full SWFP
will be required for facilities handling C&D waste and the registration tier
will be available for facilities that process C&D debris. After the close of
the 15-day comment period, staff will return to the full Board in January (not
the P&E Committee) to report and possibly request adoption.
- The Board approved,
on consent, the adoption of the Closure and Postclosure Maintenance
regulations. The 15-day comment period ran from November 13 through November 27,
2002. There were no comments received during the 15-day comment
period. It is anticipated that the regulations will become final in late winter
2003.
- The Committee was
updated on the Alternative Daily Cover Use investigations currently in
progress. There was limited discussion mostly due to time constraints. It
was suggested that the investigations continue and a P&E Committee workshop
be scheduled to more thoroughly explore the issues.
- The Committee
acknowledged the usefulness and efficacy of the Permit Application Submittal
Schedule and directed staff to continue with the pilot
program.
- The Board concurred in
one solid waste facility permit.
- This was Member
Sal Cannella's last Board meeting. His term expires January 1,
2003.
- Assemblyman Carl
Washington replaced Dan Eaton and this was his first Board meeting. Mr.
Washington's term ends on January 1, 2006.
- The next P & E
Committee meeting will be held on January 6, and the Committee
plans to conduct a workshop on Goal 4 of the Board's Strategic Plan as it
relates to the Permitting and Enforcement Division
activities.
- The P&E Committee and
Board meetings are being audio broadcast and are available from almost any
personal computer with Internet access.
