This all LEA e-mail was sent on behalf of Scott Walker, Acting Deputy Director of the Permitting & Enforcement (P&E) Division and the LEA Support Services Branch of the California Integrated Waste Management Board. These Board and P&E Committee Meeting summaries will be sent after each Board and P&E Committee Meeting.

Permitting and Enforcement (P&E) Committee Meeting: Tuesday, November 12, 2002
Board Meeting: November 19 & 20, 2002

Board and P&E Committee Meeting Summary:

  • The Board voted unanimously to adopt the proposed regulations for the Compostable Materials Handling Operations and Facilities Requirements. Staff will be reporting back to the Board on the progress with implementation of the proposed regulations.
  • The P&E Committee directed staff to bring the proposed Construction and Demolition and Inert Debris Processing Tiered Regulations (Phase I) back to the Committee in December with proposed language that will be "franchise agreement neutral" with regard to the use of "debris" and/or "waste" in the definitions. Additionally, staff was directed to include regulatory language to allow a temporary Registration Tier permit for facilities that process 100 TPD or more while a full tier permit is being obtained. Staff will seek direction from the Committee on December 2 to initiate a 15-day comment period on the changes. A stakeholders meeting is being held todayNovember 20 in Sacramento.
  • CIWMB conducted the public hearing for the proposed regulations for the Waiver of Permit Terms and Conditions during temporary emergencies at the November 12 P&E Committee meeting. CIWMB staff publicly noticed the proposed regulations on August 31, 2002. Staff received no comments during the 45-day comment period. At the public hearing on November 12, one commenter raised concerns regarding whether the stipulated agreement (SA) is an enforcement order The Board's Legal Office responded that the SA is an enforcement order and that it can be appealed with an ability to stay the SA unless the LEA decides there is an immanent health threat if operator is not allowed to operate under a SA.  Later, during the committee meeting, another commenter stated they didn't feel it was appropriate for the Board's Executive Director to review and change, if warranted, a SA issued by an LEA. This comment will be addressed in the Final Statement of Reasons for the regulatory package. Staff anticipates that the regulations will be brought to the Board for adoption at the December meeting.
  • The P&E Committee directed staff to initiate a 15-day comment period for changes to the regulation text for Closure and Postclosure Maintenance. There are minor changes to the first version of the proposed regulations. The changes for consideration in the 15 day comment period are in two categories: modifications to clarify the original regulatory intent and modifications to provide consistency with other regulations, including State Water Resources Control Board regulations. The 15-day comment period will run from November 13 through November 27, 2002.
  • CIWMB conducted the public hearing for the proposed Waste Tire Monofill Regulations on November 12 during the P&E Committee. The 45-day public comment period on the proposed regulations began on September 6, 2002, and closed on October 21, 2002. The regulations will probably go back to the Committee to request another 15-day comment period in early 2003. Some additional changes may address SWRCB's new design and construction standards, some additional RDSI requirements and suggested changes to technical standards such as cell size variability.
  • The Board approved the adoption of the proposed regulations for Inventory of Solid Waste Facilities Which Violate State Minimum Standards.
  • The Board concurred in three solid waste facility permits.
  • he next P & E Committee meeting will be held on December 2, there will not be a workshop at the December Committee meeting.
  • The P&E Committee and Board meetings are being audio broadcast and are available from almost any personal computer with Internet access.
