This all LEA e-mail was sent on behalf of Scott Walker, Acting Deputy Director of the Permitting & Enforcement (P&E) Division and the LEA Support Services Branch of the California Integrated Waste Management Board. These Board and P&E Committee Meeting summaries will be sent after each Board and P&E Committee Meeting.

Summary of Board, Special Board and P&E Committee Meetings:

  • At the special meeting on April 9 p.m. the Board approved the adoption of the Phase I Proposed Construction and Demolition (C&D) and Inert Debris Processing Tiered Regulations. The proposed regulations include language that establishes the following:
  1. A tiered permit structure with:
    0 - less than 25 TPD = EA Notification Permit Tier;
    25 TPD - less than 175 TPD = Registration Permit Tier;
    175 TPD and more = Full Permit Tier.
  2. A registration tier residual percentage of 40%s
  3. Mandatory Division of Occupational Training and Health (DOSH) training for LEAs
  4. Operator requirement to include the injury, illness and prevention plan (IIPP) in the plan or report.
  5. "3 Strikes" language for operators found by the LEA to exceed certain limits.
  6. Amended the "processing" definition.
  7. A public gearing/community outreach requirement by the LEA.
  8. Specified language regarding the origin of C&D-like material.
  9. Full permit phase-in time limits of 2 years with up to a 3 year LEA extension.
  10. Requirement for a fire plan.
  11. Requirement for tonnage records based on actual weight.
  12. Added unannounced and randomly scheduled inspection language.
  • The acting deputy director reported that the three priority C&D sites in Sacramento, Riverside and Imperial Counties have had enforcement orders issued and clean up has been initiated.
  • The Board concurred in three solid waste facility permits. All three permits were heard by the full Board. The Bradley permit was heard on April 9 and there was testimony from legislators and public expressing concerns regarding possible radioactivity and other possible negative impacts. The Amador County Sanitary Landfill proposed permit raised questions about a large wood waste pile which was removed and financial assurances.  Additionally, there were citizen concerns about possible negative environmental and health impacts. The Santa Barbara County Tajiquas Landfill proposed permit had testimony about slope stability during an earthquake, possible ocean pollution and other environmental concerns.  The concerns were addressed and the permits concurred in.
  • The Committee directed staff to begin the 45-day comment period on two regulation packages: 1) landfill closure loan program and 2) concerning landfill capacity reporting requirements included in the solid waste facility permit (SWFP) application form.
  • A public hearing was held at the Committee meeting for the phase II proposed construction and demolition and inert debris disposal regulations. It is anticipated that at the May 5 P&E Committee meeting there will be a request for another 15 day comment period.
  • The semi-annual update of the Inventory of Solid Waste Facilities Which Violate State Minimum Standards was heard by the Committee. The regulations for the Inventory process became effective April 3, 2003.
  • There was an informational item on for Board Members on the Bagley-Keene Act at the April 23 Board meeting.
  • The proposed permit for Los Angeles Sunshine Canyon Landfill will be heard by the full Board next month with an abbreviated presentation at the P&E Committee.
  • The Committee heard an informational report on enforcement orders issued by local enforcement agencies from August 2002 through February 2003. Cease and desist orders issued by EAs will be discussed at the May 5 P&E Committee meeting.
  • On May 8 there will be a public workshop for Board members on Solid Waste Facility Permitting, Inspection And Enforcement Processes.
  • The next P&E Committee meeting will be held on May 5, and the next Board meeting will be on May 13 -14 in Sacramento.
  • The P&E Committee and Board meetings are being audio broadcast and are available from almost any personal computer with Internet access.
