August Permitting and Enforcement Committee and Board Meeting Summaries

This all LEA e-mail was sent on behalf of Howard Levenson, Deputy Director of the Permitting and Enforcement Division and the LEA Support Services Branch of the California Integrated Waste Management Board. These summaries will be sent after each Board and P&E Committee Meeting.

Permitting and Enforcement (P&E) Committee Meeting: Monday, August 4, 2003

Board Meeting: August 12-13, 2003

Summary of Board and P&E Committee Meetings:

  • The Board concurred in three full solid waste facility permits, all on the consent agenda.
  • The Committee directed staff to begin a 15-day comment period for revisions to the alternative daily cover (ADC) regulations. The comment period runs from August 7 through August 22, 2003.
  • The Committee directed staff to begin a 15-day comment period for revisions to the construction and demolition waste and inert debris (CDI) disposal phase II regulations and to develop and include alternative regulatory language for two issues, defining fill at an inert debris engineered fill site and  the requirement for scales. The comment period will allow stakeholders to review and consider several alternatives during a single comment period. The comment period runs through August 27, 2003.
    The two issues and alternatives are as follows:
  1. Defining fill at an inert debris engineered fill operation: 1) use the current language; 2) an alternative that does not call fill at inert debris engineered fill operations “disposal”; and 3) an alternative that does not call fill at an inert debris engineered fill operation "disposal" along with an explanation that inert debris is not counted as diversion or disposal for a given jurisdiction.
  2. Scales/Weight Records Requirement: 1) an alternative with the requirement of scales or weight records that can be obtained from other sources such as generator, hauler or off-site scales; 2) an alternative that requires weight records in the regulations but allows for a volumetric conversion when scales are not economical; and notice as an alternative the deletion of the weight records requirement.
  • The Sustainability and Markets Development Committee heard a discussion on when a proposed facility expansion would require an amendment to the applicable planning document. The issue is adequate identification of the facility location in the planning document when there is expansion beyond the original boundaries. The Committee directed staff to prepare an agenda item to adopt staff recommendations, with further research and input from stakeholders.
  • The Board approved a recycling market development zone (RMDZ) loan for Loony Bins in Los Angeles to purchase construction and demolition (C&D) recycling equipment.
  • The Board approved a grant from the Tire Fund to clean up damage in the Bennett Valley School District from a tire chip fire. They also requested that policy be developed regarding limitations on use of cleanup/remediation funds for such sites.
  • The next P&E Committee meeting will be held at 1 p.m. on  September 8, and the next Board meeting will be on September 16-17 in Sacramento.
  • The P&E Committee and Board meetings are being audio broadcast and are available from almost any personal computer with Internet access.
