September Permitting and Enforcement Committee and Board Meeting Summaries

This all LEA e-mail was sent on behalf of Howard Levenson, Deputy Director of the Permitting and Enforcement Division and the LEA Support Services Branch of the California Integrated Waste Management Board. These summaries will be sent after each Board and P&E Committee Meeting.

Permitting and Enforcement (P&E) Committee Meeting: Monday, September 8, 2003
Board Meeting: September 16-17, 2003

Summary of Board and P&E Committee Meetings:

  • The Board concurred in two full solid waste facility permits, both on the consent agenda.
  • The Committee directed staff to begin another 15day comment period for revisions to the ADC regulations. The comment period runs from September 15 through September 30, 2003. It is anticipated that the regulations will return for adoption in October.
  • The Board adopted the construction and demolition (C&D) waste and inert debris  disposal phase II regulations and resolution 2003-449, revised. The regulatory language does not use the term "disposal" relative to inert debris engineered fill operations and includes an explanation that inert debris is not counted as diversion or disposal for a given jurisdiction. Also, the adopted regulations do not require a scale when calculating weight records for engineered fills, but weight records (based on scales) would be required within 1 year for other C&D disposal sites, except for those in rural counties and cities and that will close within 3 years.
  • The Committee directed staff to develop landfill operations training/certification regulations, beginning with an informal rulemaking process to require certification for on-site landfill managers responsible for day-to-day operations and for state and local landfill inspectors.
  • The Committee directed staff to develop long-term gas violation policy regulations, that codify the regulatory concepts developed by the working group and include penalty language. In the interim, staff was directed to use the existing policy until the Office of Administrative Law approves the new regulations and they become effective.
  • The Committee heard a presentation on Southern California tree mortality due to bark beetle infestation (Word 97, 75 KB) and related wood waste issues.
  • The next P&E Committee meeting will be held at 1:00 p.m. on  October 6, and the next Board meeting will be on October 15-16 in Sacramento.
  • The P&E Committee and Board meetings are being audio broadcast and are available from almost any personal computer with Internet access.
