Date: September 8, 2003 To: All Local Enforcement Agencies This all LEA E-mail was sent on behalf of the LEA Support Services Branch of the California Integrated Waste Management Board (CIWMB) and Howard Levenson, Deputy Director for the Permitting and Enforcement Division. Issue: Jurisdiction pertaining to odors at composting facilities and operations. The CIWMB in conjunction with certified LEAs retains regulatory enforcement authority in regards to odors generated from compostable material sources. The provisions of SB 88, Chaptered 10/02/01, were satisfied when the rulemaking package for Compostable Materials containing odor impact minimization requirements were submitted to the Office of Administrative Law prior to April 1, 2003. The odor impact minimization requirements became effective on April 4, 2003. The Compostable Material Regulations require all operating compostable material sites, excepting some agricultural operations, to maintain an Odor Impact Minimization Plan (OIMP), Section 17863.4. The regulations may be found through the Compostable Rulemaking Archives page on the Board's web site. The CIWMB will be working to bring interested parties together for the purpose of resolving odor impacts emanating from compostable materials sites. To this end the CIWMB will be offering individualized training to the State's APCD/AQMD's, LEAs and interested parties.
