Local Enforcement Agency Correspondence Rescission of LEA Advisory #12 |

Date: January 22, 2004 To: All Local Enforcement Agencies This all LEA email was sent on behalf of Howard Levenson, Deputy Director of the Permitting and Enforcement Division of the California Integrated Waste Management Board. At its January 13, 2004 meeting, the Board directed staff to rescind LEA Advisory #12, "Permitting of Nontraditional Facilities." The purpose of the advisory was to provide guidance to LEAs and Board staff on the permitting of nontraditional facilities while the Board and its stakeholders evaluated the need to permit these facilities. With the adoption of the Construction and Demolition Waste and Inert Debris Disposal regulations, the Board's regulations provide a comprehensive regulatory permitting structure. Existing regulations now address the permitting requirements for any solid waste facility. LEA Advisory #12, therefore, is no longer necessary and is hereby rescinded. Consequently, LEAs should actively pursue any solid waste facilities operating without a permit, including those handling what may have been previously considered "nontraditional" materials. The Permitting and Inspection Branch has and will continue to assist LEAs in determining what activities require a permit and where the activities fit in the existing tiered regulatory structure.
