Summary of the Board and P&E Committee Meetings on items of possible interest
to LEAs:
- The Board awarded $169,822 to three jurisdictions to support the
cleanup of 17 illegal disposal sites on farm and ranch property. The
cleanup of these sites will eliminate the health and safety threat posed
by the waste to the public, wildlife, and the environment. The approval
of the three grants was for the second quarter of fiscal year 2004/2005
for the Farm and Ranch Solid Waste Cleanup and Abatement Grant Program.
- The Board approved two new projects in Monterey County to be cleaned
up under the Solid Waste Disposal and Codisposal Site Cleanup Program.
This program addresses cleanup of solid waste disposal and codisposal
sites where the responsible party either cannot be identified or is
unable or unwilling to pay for a timely remediation and where cleanup is
needed to protect public health and safety or the environment. These two
projects are estimated to cost $300,000, which would leave $1,275,482
available in the contract fund.
- The Permitting and Enforcement (P&E) Committee, held a public
hearing for the proposed Conversion Technology regulations, which would
regulate conversion technology operations and facilities in the same
manner as other Transfer and Processing operations and facilities. No
decisions were made at the public hearing during the P&E Committee
meeting.
- The Committee also held a public hearing for the proposed RCRA
Subtitle D Program Research Development & Demonstration (RD&D)
regulations. The proposed regulations would incorporate USEPA’s RCRA
Subtitle D Research Development & Demonstration Permit flexibility in
California’s subtitle D program. As directed by the Board at the July 14
meeting, staff gathered more comments on a few issues (pre-processing
requirements, limit on permits issued, research protocols, and etc). The
45 day comment period closed November 30. The RD&D regulations will come
back to the Board for either adoption or another comment period.
- The Board concurred in four full solid waste facility permits (SWFP)
and took no action on one permit for a new facility, the Gregory Canyon
landfill. Two Board members voted to deny the permit, three Board
members voted to concur with the issuance of the permit, and one Board
member recused herself. Four votes are needed for an action to be taken.
Since there was no action taken, the LEA will be able to issue the
permit after the 60-day CIWMB timeframe expires.
- The Board adopted the 2005 Rulemaking Calendar, which lists 19
potential regulatory packages. Government Code Section 11017.6 requires
the California Integrated Waste Management Board (CIWMB) and all other
State agencies to prepare, by January 31 each year, a rulemaking
calendar for that year. The proposed 2005 Rulemaking Calendar was
developed with input from each of the Board’s divisions and offices. The
2004 rulemaking calendar listed 25 potential rulemaking packages. During
the past year, 6 were approved by OAL:

Landfill Application Revisions rulemaking package has been approved
by the Board and is pending approval from OAL.
The next Board meeting will be on January 18-19, 2005 in Sacramento. The
P&E Committee will meet on Monday, January 10, 2005 at 10 a.m.
