July Board Meeting Summary

Permitting and Enforcement (P&E) Committee Meeting: July 6, 2004

Summary of the Board Meeting:

  • The Executive Director reported on four emergency waivers that are currently in effect. Three waivers were issued to handle the destroyed tree debris that resulted because of the bark beetle and fire devastation in San Bernardino County. One was issued to accommodate the earthquake debris that resulted from the destructive earthquake in San Luis Obispo County.
  • The Deputy Director reported that the remediation project approved by the Board last month to clean up Aggregate Recycling Systems Illegal Disposal Site (La Montana), is proceeding forward. On July 13, the court agreed with the city and appointed a receiver to clarify site access and other issues. Board staff have filed the Notice of Exemption and continue preparation of the final work plan, which will be presented to the community for comment at a public meeting. After the November 1994 Northridge earthquake, this site had accumulated debris up to 50-60 feet in height with up to 200,000 tons. Approximately 80,000 cubic yards of inert debris remain onsite. The pile has constituted a public nuisance and potential health threat because of dust, erosion, concerns over potential contaminants, and negative visual impacts.  Depending on discussions with the receiver, the Board hopes to begin remediation in August or September.
  • The Deputy Director reported that the operator waived the timeline for the proposed new solid waste facility permit for the Gregory Canyon Landfill.  The item was pulled from this month’s agenda and is re-scheduled to be heard by the Board in August. In the November 1994 General Election,  San Diego voters approved Ordinance C which amended the County’s General Plan to allow the construction and operation of the Gregory Canyon landfill and recycling center. The San Diego County Board of Supervisors have received a petition to add a November 2004 ballot item that would invalidate Ordinance C and amend the General Plan to prohibit the construction and operation of a landfill and recycling collection center in Gregory Canyon. The Board of Supervisors requested that their staff analyze the impact of the petition and report back to them on August 3. 
  • The Board concurred in the issuance of two revised full solid waste permits, one for a transfer station and the other for a composting facility.
  • The Board approved three new projects for clean up pursuant to the Solid Waste Disposal and Codisposal Site Cleanup Program. Two projects involve improvements to or installation of landfill gas collection systems to protect the surrounding areas and communities. The third project was for the clean up of 25 high-priority chronic dumping locations and to assist in the implementation of mitigation strategies to reduce future illegal dumping in various susceptible areas.
  • The Board approved staff’s request to formally notice the proposed regulations for Research, Development, and Demonstration (RD&D) Permits for Municipal Solid Waste Landfills for a 45-day public review and comment period. The proposed rule will provide for site-specific variances from certain Subtitle D criteria necessary to implement innovative MSW landfill technologies (such as bioreactor landfills), provided that the owner/operator demonstrates that compliance with the variance will not increase risk to human health and the environment over the standard requirements. After discussion at both the Committee and Board meetings, during the 45 day comment period additional input will also be sought on three concepts: 1) requiring additional research protocols, such as control cells; 2)  limiting the number of permits issued under the rule; and 3) a requirement that waste sent to bioreactor landfills be pre-processed.
  • The Board approved the proposed modifications to the grant scoring criteria for grants issued under the Farm and Ranch Grant Program. The modifications make minor revisions to the General Criteria definitions and scores to give more emphasis to the need and work plan. They also give higher priority to sites that represent a greater threat to the environment and/or public health and safety; and add a new criteria item that gives 7 priority points to those applicants that did not receive a Farm and Ranch Solid Waste Cleanup and Abatement Grant in the previous fiscal year to provide new applicants a small advantage and distribute funding to new areas.  This item was approved on fiscal consensus.
  • The P & E Committee heard a discussion of current and planned regulatory and research activities related to landfill facilities, including potential follow-ups to the landfill facility compliance study. A more formal item will be presented to the Board in September.
  • There were many employee suggestions for improving the Board and CIWMB staff processes and procedures. The suggestions were received at the Division meetings and from the on-line anonymous suggestion box. The Board requested that each Division summarize and prioritize their staff’s suggestions and present the results to appropriate Committees.
  • The Board heard a discussion of one of the employee suggestions for strengthening the message of the importance on buying recycled-content products and promoting markets for material diverted from landfills. The suggestion was to consider whether grant applicants should be disqualified from receiving grants offered by the Board if they do not have green procurement policies in place, such as purchasing recycled content materials. If implemented, this proposed change would have an impact. For example, 22 of the 53 applicants (42%) for the Household Hazardous Waste Discretionary Grants (FY 02/03) would not have been eligible for grant funding since they did not have green procurement policies.  No further consideration is planned at this time.
  • The next Board meeting will be on August 17 and 18, 2004 in Sacramento. The P&E Committee will meet on Monday August 9, 2004 at 10 a.m.
