March Board Meeting Summary

This all LEA e-mail was sent on behalf of the LEA Support Services Branch of the California Integrated Waste Management Board (CIWMB) and Howard Levenson, Deputy Director Permitting and Enforcement Division.

Board Meeting: March 16, 2004

No Permitting and Enforcement (P&E) Committee Meeting in March

Summary of the Board Meeting:

  • There were no P&E Division agenda items this month.
  • The Executive Director mentioned that the diversion rate has declined slightly, from 48% to 47%. The Board requested that CIWMB's programs be evaluated and innovative ideas solicited and implemented to assure that diversion rates increase and surpass 50%.
  • Board members complimented the very successful CIWMB/LEA Partnership Conference in March, specifically noting the Open Forum and CEQA working group sessions. In addition, some members expressed concern regarding some of the LEAs' interpretations of CEQA with respect to the permit process.
  • The Board adopted a model construction and demolition (C&D) diversion ordinance. Senate Bill (SB) 1374 (Kuehl; Statutes of 2002) required the Board to develop and adopt a model construction and demolition (C&D) diversion ordinance. The bill does not require that jurisdictions adopt the Board's Model Ordinance as their own, nor does it require jurisdictions to have their own ordinance. The intent of the bill was to provide local jurisdictions with a tool to assist them with diverting C&D waste. Board staff developed the Model Ordinance based on sample ordinances already being implemented by jurisdictions and incorporated the most typically used sections into the Model Ordinance thereby creating another good tool for jurisdictions.
  • The Board heard an update on the implementation of Senate Bill (SB) 20, the Electronic Waste Recycling Act of 2003 (Act). CIWMB staff continue to draft emergency regulations and anticipate posting them on the Board's website on March 23, 2004. In order to discuss the draft emergency regulations, staff will conduct a stake holder's workshop on April 2nd at the CalEPA Headquarters. Staff will then present the emergency regulations to the Board at the April 13 - 14, 2004 Board Meeting. SB 20 requires that beginning July 1, 2004, retailers collect the electronic waste recycling fees on covered products sold to all California consumers, and transmit fees to the Board or contracted agency.
  • The Board approved five (5) scopes of work and allocations to be funded from the 2003/2004 from the Integrated Waste Management Account  (IWMA) savings. Throughout this fiscal year, the Board has operated within the restraints of the current budget situation, and  there was a savings in the IWMA in the amount of $1,100,000. The five contract concepts are for the following: (1) Contract Concept No. 1 - The objective of this Organic Facilities Permitting and Odor Response Project is to assist in resolving the problem of odor complaints at organic materials management facilities. The Project includes both a proactive and reactive approach. The proactive approach focuses on preventative measures to so that environmental impacts of organic materials management facilities are properly considered and planned for at the earliest planning, siting, and permitting stages. The reactive approach provides practical tools for LEAs to more effectively respond to existing odor complaints and specific mitigation strategies for operators to use in minimizing odor impacts($175,000); (2) Contract Concept No. 2 - The purpose of this proposal, the Statistical Analysis of the Board -approved Adjustment Method for Estimating Changes in Solid Waste Generation, is to determine whether the method used to estimate changes in waste generation can be updated and/or improved to reflect recent and potential future changes in California's economy ($50,000); (3) Contract Concept No. 3 - The purpose of this proposal is to develop environmental education curriculum for K-12 students for consideration by State education agencies in response to AB 1548 ($250,000); (4) Contract Concept No. 4 - This electronic waste related contract proposes to bring on-board the resources and expertise needed to create a partnership with covered electronic device (CED) manufacturers and retailers to inform the public about the hazards of improper CED storage and disposal; and provide information on opportunities and locations where CEDs can be properly returned for recycling and disposal ($200,000); (5) Contract Concept No. 5 - This electronic related waste concept will assist in establishing electronic waste fee collection at the point of sale and payment for collection and recycling, registration and tracking of fee payers, and customer service for the fee paying community relating to the recycling of CEDs. The Board is currently negotiating with the Board of Equalization (BOE) to provide a portion of these services. Depending on the outcome of those discussions, it may be necessary for Board staff to assume responsibility for a portion of the fee collection process ($425,000).
  • The next Board meeting will be on April 13-14, 2004 in Sacramento.
  • The Board meetings are being audio broadcast and are available from almost any personal computer with Internet access.
  • There is no P&E Committee Meeting scheduled for April.
