October Board Meeting Summary

This all LEA e-mail was sent on behalf of the LEA Support Services Branch of the California Integrated Waste Management Board (CIWMB) and Howard Levenson, Deputy Director Permitting and Enforcement Division.

Board Meeting: October 13, 2004

Permitting and Enforcement (P&E) Committee Meeting: October 4, 2004

Summary of the Board and P&E Committee Meetings on items of possible interest to LEAs:

  1. Board Chair Marin announced that “Public Comment” will occur at the beginning of the meeting rather than at the end to facilitate greater public participation. Public comments on items on the agenda will still be heard at the time the item is presented. Additionally, it was mentioned that those listening to the broadcast of a Board meeting may soon be able to view the presentations shown in the Board room at the same time as shown to the Board members. This service may be available in several months.
  2. The Board approved proposed changes in the applicant eligibility and program criteria for the Waste Tire Enforcement Grant Criteria. Some of the changes include having the grant applicants basically limited to LEAs and/or Code Enforcement, flexibility in re-inspections, vehicle purchasing terms,  performance criteria and provisions for allocating funds if the grant becomes over-subscribed.
  3. The Board concurred in three revised full solid waste facility permits: two disposal facilities and one transfer processing facility. All were on the consent agenda.
  4. The P&E Committee heard a discussion of the Inventory of Solid Waste Facilities Which Violate State Minimum Standards (Inventory). The Inventory is published twice annually and updated routinely. Facilities in violation of the terms and conditions of their permits, as opposed to State Minimum Standards, are not included in the Inventory. There are currently 11 sites on the Inventory. The Committee discussed making the Inventory a real-time list and providing more enforcement tools to LEAs to assist with enforcement actions.
  5. The Board approved the augmentation of the Solid Waste Disposal and Codisposal Site Cleanup Program (2136 Program) contracts with the two previously approved remediation contractors. This program allows the Board to remediate threats to public health and safety or the environment at eligible sites in a timely manner. The estimated costs of previously approved projects, coupled with anticipated costs associated with cleanup of the Aggregate Recycling Systems (ARS) Illegal Disposal Site (La Montana), exceeded the available funding in both current contracts so the augmentation was needed.

The next Board meeting will be on November 9-10, 2004 in Sacramento. The P&E Committee will meet on Wednesday November 3, 2004 at 10 a.m.
