Permitting and Enforcement (P&E) Committee Meeting: August 8, 2005
Summary of the Board and P&E Committee Meetings on items of possible interest
to LEAs:
- The Executive Director reported that the San Bernardino County LEA
extended emergency waivers for landfills to allow them to continue to
exceed tonnages to handle excess tree debris from the devastation caused
by the bark beetle infestation. The Executive Director mentioned that
when prolonged conditions impact the waste stream, a permit revision
rather than extensions of emergency waivers may be more appropriate.
- At the P&E Committee, the Deputy Director reported on several
upcoming events:
- On September 12, after the P&E Committee meeting, staff will
conduct a facilitated stakeholder discussion/workshop to look at
LEA/operator training issues including those raised by the Board in
during the April Permitting and Enforcement Committee Meeting. Staff
will present the results in a follow up agenda item for Board
consideration during late winter.
- Coming up in Winter 2006, after a P&E Committee, staff will
conduct an enforcement policy workshop to explore compliance and
formal actions in addition to looking at gaps in the appeals
process. Staff intends to bring a subsequent agenda item to the
Board on policy issues generated by this workshop.
- Additionally, in November, staff will coordinate three, regional
“Fire Prevention in Stored Waste Piles Coordination” meetings for
LEAs and local fire officials. The meetings will be held in Fresno
on 11/02, Marysville on 11/09 and Irvine on 11/29. The meetings will
serve as an opportunity for all parties to get to know each other,
exchange case studies, discuss prevention measures, and enhance or
establish working relationships. After the regional meetings,
results will be consolidated for the State Fire Marshall who intends
to convene an advisory group to begin work on fire plan
requirements, either as a model ordinance that would be incorporated
into state building standards, or as new regulations in Title 19.
- The Deputy Director reported that the Board’s role in the clean up
of the Aggregate Recycling Systems Illegal Disposal Site (La Montana) is
now complete, (except to receive recovered costs). After the November
1994 Northridge earthquake, this site had accumulated debris up to 50-60
feet in height with up to 200,000 tons. The site was a public nuisance
and potential health threat because of dust, erosion, concerns over
potential contaminants, and negative visual impacts. At the court
hearing on 7/28, the judge approved the Receiver’s request to proceed
with the sale of the property to recover costs, which will go to the
receiver, the City, and the Board, including the additional costs beyond
the Board’s initial estimate of $2.1 million.
- The P&E Committee directed staff to halt the formal rulemaking of
the proposed amendments to the transfer/processing operations and
facilities regulatory requirements to deal with conversion technology
operations and facilities until identified statutory inconsistencies
have been addressed. Even though these proposed regulations have been
postponed, conversion technology facilities and operations would still
be subject to regulation on a case-by-case basis under the existing
transfer/processing operations and facilities regulatory requirements,
which includes the “3-part test” as a basis for determining whether or
not an individual facility requires a solid waste facilities permit and
would be subject to operational regulations.
- The Board concurred in six full solid waste facility permits (five
were revised permits and one was for a new facility).
The next Board meeting will be September 20-21, 2005 in Sacramento. The P&E
Committee will meet on Monday, September 12, 2005 at 10 AM in Sacramento.
