Summary of the Board and P&E Committee Meetings on items of possible interest
to LEAs:
- All welcomed the newest Board member, Gary Petersen, to his first
Board meeting. Mr. Petersen was appointed by the Governor as the
Environmental representative, filling the vacancy left by Mr. Paparian.
- The Executive Director reported on one emergency waiver issued by
the Los Angeles County LEA to allow the Burbank Landfill to extend its
operating hours to accept waste from recent wildfires and landslides.
- The Board heard a presentation on Executive Order S-3-05 which
establishes greenhouse gas (GHG) emission reduction targets for
California and charges the California Environmental Protection Agency
Secretary with coordinating oversight of efforts to achieve those
targets. The Order plans a reduction of GHG emissions to prior year 2000
levels by 2010; a reduction of GHG emissions to 1990 levels by 2020; and
a reduction of GHG emissions to 80% below 1990 levels by 2050. To help
with reaching the targeted goals, the Board has identified achieving a
50% statewide diversion rate, more landfill methane gas capture and Zero
Waste Recycling efforts as strategies for greenhouse gas emission
reductions.
- The Board approved adoption of the amendments to the emergency
regulations for the implementation of the Electronic Waste Recycling Act
of 2003. The informal rulemaking process for permanent regulations has
been initiated. The emergency regulations will sunset in December 2006.

- The approved revisions define, clarify and standardize the
requirements associated with being a "designated approved collector"
and the contents of a "proof of designation". Such a designation
will allow an approved collector to provide CEW services on behalf
of a local government and be relieved of certain source
documentation requirements while performing specified services.
- The revisions also allow properly documented "source-anonymous
CEWs" that result from specified circumstances to be eligible within
the payment system. These circumstances include load check
activities at a permitted solid waste facility, illegal disposal
clean-up activities conducted by an approved collector that is a
local government or its designated collector, and illegal disposal
at the facility of an approved collector that is a non-profit
organization. Among other definitions, the revisions define illegal
disposal and load check activity.
- Finally, the revisions postpone by one month the due date for
the net cost report from February 1, 2006, until March 1, 2006.
- The Board concurred in two revised full solid waste facility
permits. One permit was approved on consent. The other permit was pulled
from the consent agenda and there was discussion on the violations of
state minimum standards found during the CIWMB pre-permit inspection.
- The Board directed staff to initiate the formal rulemaking process
with a 60-day comment period for the
proposed permit implementation regulations, after staff has
additional discussions with stakeholders on identifying ‘nonmaterial’
changes to a permit that are not significant enough for either a permit
revision or RFI amendment. Two work group meetings were scheduled for
November 21 and November 29 in Sacramento. These permit implementation
regulations are the first of three planned packages that the Board
directed staff to complete.
- There are several upcoming events. The Fires at Solid waste
Facilities Coordination meetings have been very successful. The last
meeting of this series will be held in Irvine on November 29. In
January, there will be workshops on Landfill Gas Monitoring and Control
Strategies at Developed Sites, one in Alameda and another in Orange
County. In February, there will be a series of Landfill Post Closure
Land Use Symposia held in various locations.
- On December 5, the Board’s Hearing Panel will consider the appeal of
a Notice And Order issued by the CIWMB acting as Enforcement Agency for
San Luis Obispo County; the hearing will be broadcast.
The next Board meeting will be on December 13, 2005 in Sacramento. The
P&E Committee will meet on Monday, December 5 at 10:00 a.m. in Sacramento.
