on behalf of the LEA Support Services Branch of the California Integrated Waste
Management Board (CIWMB) and Howard Levenson, Deputy Director Permitting and
Enforcement Division.

Permitting and Enforcement (P&E) Committee Meeting: October 3, 2005
Summary of the Board and P&E Committee Meetings on items of possible interest
to LEAs:
- Four full solid waste facility permits were brought before the
Board: two revised permits and two new permits. The two revised permits
were approved on consent. The two new permits were pulled from the
consent agenda and engendered much discussion regarding whether there
had been public hearings and adequate community participation for the
new permits. The Board concurred with one new permit for a
composting facility in Kings
County. The Board voted 3-1 on the other new permit with one Board
member objecting due to concerns that there may not have been enough
opportunity for public participation in the permitting process.
Therefore, because 4 votes are needed for the Board to act, no action
was officially taken on this item. When no action is taken, the Board is
deemed to have concurred in the issuance of the permit as submitted (PRC
44009).
Related to the concerns raised at the Board meeting, staff will bring
the proposed permit implementation regulations before the P & E
Committee next month to seek direction on initiating formal rulemaking.
These draft regulations include proposed language in the requirements
for holding public hearings for new facilities and tracking public
outreach.
- The Board’s Legislative office gave a
summary of this session’s
signed bills. Very briefly, some recently signed bills of interest
include AB 1125 which requires that retailers accept used recyclable
batteries; AB 1065 requiring registration to haul grease trappings; and
AB 1249 which gives the Fire Marshall authority to develop regulations
for waste tire storage.
- Some upcoming events include three regional “Fire Prevention in
Stored Waste Piles Coordination” meetings for LEAs and local Fire
officials, sponsored by the CIWMB, CCDEH and the State Fire Marshall’s
office. The meetings will be held in Fresno on 11/2, Marysville on 11/9,
and Irvine on 11/29. They will serve as an opportunity for all parties
to exchange case studies, discuss prevention measures, and enhance or
establish working relationships. Additionally, DTSC will be sponsoring
two workshops on October 24 and 26 to discuss the upcoming expiration of
the Universal Waste landfill disposal exemption in February 2006. The
DTSC workshop on October 24 will be held in Sacramento and broadcast
over the web (questions may be submitted during the broadcast). The
workshop on Oct. 26 will be held at DTSC's Regional office in Berkeley
with a video connection to DTSC's Regional office in Glendale.
The next Board meeting will be on November 15, 2005 in San Diego. The P&E
Committee will meet on Monday November 7, at 10 a.m. in Sacramento.
