Summary of the Board and P&E Committee Meetings on items of possible
interest to LEAs:
- The Board concurred in three solid waste facility permits, all were on
the consent agenda. One new permit for a transfer station (but where there
were existing activities that required a permit) was pulled from the Board
agenda, after the operator waived the 60-day clock for an additional 30
days. The P&E Committee Members heard much public testimony about the
perceived negative impact of the facility on their community and the lack of
notification about the permitting of the facility. Several Board members
noted that although no public hearings are required for new permits, more
public outreach should have been done. The permit is currently scheduled to
be placed on the May Board agenda.
- The Board approved a $500,000 interest free loan from the Landfill
Closure Loan Program (LCLP) for the early closure of the Neal Road Landfill
in Butte County. The Board is authorized to award loans to operators of
unlined, older technology landfills desiring to close early to avoid or
mitigate potential environmental problems caused or threatened by continued
operation of the site as established by Assembly Bill 467. Priority is given
to facilities that are small, are located in rural areas, have approved
closure and postclosure maintenance plans, and/or have the highest degree of
risk to public health and safety or the environment. The total loan amount
appropriated for the 2005/06 LCLP cycle was $630,000.
- At a hearing on April 5, the Board’s Hearing Panel heard an appeal of
a Notice and Order (N&O) issued by the California Integrated Waste
Management Board acting as the Enforcement Agency for San Luis Obispo
County. The N&O was issued to the operator of an unauthorized and unpermitted site with large stockpiles of C&D inert material that also was
continuing to receive large quantities of these materials. The Hearing Panel
upheld the Notice and Order, which requires the operator to cease and desist
from accepting more inert materials, begin processing the existing mountains
of materials and remove the processed materials within 18 months from
processing.
- Staff held two informal informational meetings on the proposed
Permit
Implementation Regulations (AB1497). The meetings were held in
Sacramento and Southern California as well as broadcast on the Internet.
The purpose of the meetings was to clarify existing proposed language,
not accept comments on the proposed regulations. A 60-day formal public
comment period on the proposed regulations began on April 7, 2006 and
runs through June 6, 2006. A public hearing is scheduled for June 5,
2006.

The next Board meeting will be on May 16, 2006, in Sacramento. The P&E
Committee will meet on Monday, May 8, at 10 a.m. in Sacramento.
