California Code of Regulations (CCR) Updates

This all-LEA e-mail was sent on behalf of the LEA Training and Health and Safety Branch and the Local Enforcement Agency Certification and Evaluation Section of the California Integrated Waste Management Board (CIWMB). 

The 2004 California Assembly Bill (AB) 2159 Statutes 2004, Chapter 448 had several purposes, one of which was to allow a Local Enforcement Agency the "option" of appointing a hearing officer instead of utilizing the three member hearing panel. Another key element in AB 2159 was to "extend the term" of a member of the hearing panel from two to four years.

When AB 2159 was chaptered into the Public Resources Code (PRC) on September 10, 2004, some sections of the California Code of Regulations (CCR) (Titles 14 and 27) became inconsistent with PRC. In order to correct this lack of consistency between the PRC and CCR, minor changes were made to the CCR as allowed by 1 CCR Section 100. This Section of the CCR allows minor changes to be made to regulations without going through the formal rulemaking procedures if the addition, revision or deletion is a ‘change without regulatory effect.'
