Financial Assurance Mechanisms

Description: New financial assurance mechanisms for local government operations of solid waste landfills: Local Government Financial Test and Guarantee. This rulemaking is based on new Federal regulations issued in 1996 (40 CFR Part 258.74).

Affected Regulatory Code Sections: Title 27, California Code of Regulations (CCR), Division 2, sections 22200, 22228, 22233, 22249 and 22249.5.

History: This rulemaking is based on new Federal regulations issued in 1996 (40 CFR Part 258.74). The Board adopted the proposed regulations on July 29, 1998. Staff delivered a completed rulemaking file to OAL on October 8, 1998. OAL approved and sent the regulations to the Secretary of State on November 23, 1998. The regulations became effective on December 23, 1998.
