The Office of Administrative Law approved the regulations on July 12, 1999
and they became effective on filing with the Secretary of State.
Description
This rulemaking completed the process initiated with emergency regulations in 1998 to
incorporate new Subtitle D flexibility into state regulation. The flexibilities are:
alternative frequency of application of daily cover and alternative frequency for
explosive gas monitoring for landfills receiving 20 tons or less of waste per day based on
an annual average.

History
The Board adopted emergency regulations at its April 29, 1998 meeting. These emergency
regulations became effective on October 28, 1998. The Board approved a 45-day formal
comment period for the permanent regulations at its December 15-17, 1998 meeting. A 45-day
comment period was held from March 19 through May 3, 1999. At the close of a public
hearing on May 26, 1999 the Board adopted the regulations. Board staff submitted the
rulemaking file to the OAL on June 24, 1999, for its 30 working day review. OAL approved
the regulations on July 12, 1999 and they became effective on filing with the Secretary of
State.

approved by OAL make permanent without change the emergency regulations.
