The Office of Administrative Law approved the changes on March 11, 1999 and
they became effective immediately. Description
The modifications to the regulations are necessary to
make the regulations consistent with SB 698 (Rainey, Statutes of 1998). SB 698 made the
following substantive modifications to the statute:
- Changes the thickness of regulated bags from 0.75 mil or greater to 0.70 mil or greater;
- Provides two options for plastic trash bag manufacturers to achieve compliance:
- Ensure that plastic trash bags intended for sale in California contain a quantity of
Recycled Plastic Post consumer Material (RPPCM) equal to at least 10 percent of the weight
of the regulated bags; or
- Ensure that at least 30 percent of the weight of the material used in all of its plastic
products intended for sale in California is RPPCM.
- Prohibits using the same RPPCM that is certified or used for compliance with any other
California or federal requirement in certifications for compliance with this program;
- Allows until January 1, 2001, for each pound of RPPCM purchased from a source of RPPCM
in California for use in the manufacture of plastic trash bags or other products
manufactured with RPPCM in compliance with the program, the manufacturer shall receive a
credit of 1.2 pounds;
- Makes any manufacturer or wholesaler who fails to comply with the program ineligible for
the award or renewal of any State contract or subcontract;
- Repeals the provision allowing for a variance for plastic trash bags using adhesive,
heat-affixed straps.

Law (OAL) on January 26,1999 as changes without regulatory effect under section 100 of
Title 1, CCR. OAL approved the changes on March 11, 1999.
