Rural Definitions

Description:  
Definition of "rural city," "rural county," and "rural area," which will allow cities or counties meeting these definitions to qualify for reduced diversion and planning requirements.

Affected Code Sections:  
Title 14, California Code of Regulations (CCR), Division 7, Chapter 9, Article 7, Sections 18774 through 18775.1

Status:  
Draft text of the proposed regulations was mailed to cities, counties, regional agencies, and interested parties on September 21, 1998.  At its November 5, 1998 meeting the Board authorized staff to begin the formal rulemaking process.  

Notice of the proposed regulations was published in the California Regulatory Notice Register on March 5, 1999 and written comments were accepted until 4:00 p.m. on April 19, 1999.  On April 14, 1999 the Board announced that it was postponing further action on the regulations until further notice and cancelled a scheduled April 27, 1999 public hearing  in Sacramento. 

Chapter 600, Statutes of 1999 (Chesbro, SB 515) now incorporates rural definitions, thus obviating the need for new regulations. Board staff has submitted "changes without regulatory effect" to make current regulatory provisions consistent with the intent and language of the statute.
