Nonhazardous, Nonputrescible, Industrial Solid Waste

The Office of Administrative Law (OAL) approved the permanent regulations and filed them with the Secretary of State on May 21, 2002.  The regulations became immediately effective upon filing.

Description
This rulemaking will establish permitting and operational standards for hazardous waste facilities that dispose of nonhazardous, nonputrescible, industrial solid waste.

History
The Office of Administrative Law approved emergency regulations July 31, 2000. The emergency regulations became effective on October 1, 2000. The OAL approved a request to extend the emergency regulations through April 11, 2002. 

The Board conducted a public workshop on January 17, 2001 to discuss the proposed permanent regulations. At its March 20-21, 2001, meeting the Board approved the proposed permanent regulations to be noticed for 45-day public comment period. A 45-day public comment period ran from October 26, 2001 through December 12, 2001. The Board conducted a public hearing at its December 11-12, 2001, meeting and directed staff to evaluate specified changes to the regulations and return to the January 22-23, 2002, meeting.

At its January 22-23, 2002, meeting the Board directed staff to make specified changes to the regulations and initiate a 15-day comment period. A 15-day comment period ran from January 31 through February 15, 2002. The Board adopted the permanent regulations at its February 19, 2002 meeting.

The Office of Administrative Law (OAL) approved the permanent regulations and filed them with the Secretary of State on May 21, 2002. The regulations became immediately effective upon filing.
