Rigid Plastic Packaging Container Recycling Rates
The amendment to regulations was approved by the Office of Administrative Law (OAL) April 10, 2002 and is effective upon filing with Secretary of State.Description
Amendment to the California Integrated Waste Management Board's
Rigid Plastic Packaging Container (RPPC) program, which requires all RPPCs, sold
or offered for sale in California to meet one of six compliance criteria.
Two of the criteria are specific to the statewide RPPC all-container
recycling rate and the statewide recycling rate for polyethylene
terephthalate (PETE) RPPCs. The amendment will allow use of the prior
year's recycling rates to determine compliance in current calendar.

History
The OAL approved emergency regulations and filed them with the
Secretary of State on September 17, 2001. At its November
13-14, 2001 meeting, Board directed staff to begin the process to make
permanent the emergency regulations and notice the regulations with OAL
for the 45-day public review and comment period. A 45-day public review
and comment period was noticed in the California Regulatory Notice
Register on November 30, 2001.
A public hearing was held at the January 22-23, 2002 Board meeting and the permanent regulations to use the prior year recycling rates to determine compliance for the current year were approved and adopted by the Board at that meeting. The permanent regulations were filed with OAL on February 28, 2002, and the amendment to the regulations was approved by OAL on April 10, 2002.
