Revision To Household Hazardous Waste Form CIWMB 303

Description

The California Department of Resources Recycling and Recovery (CalRecycle) proposes to revise form CIWMB 303 (Household Hazardous Waste Collection Information For Fiscal Year ____/____) and the associated regulatory text which apply to CalRecycle and the Department of Toxic Substances Control's (DTSC) management of household hazardous waste (HHW) programs. The proposed regulations will provide clear program guidance to CalRecycle , DTSC, and local HHW governing bodies.

Status

A notice of a second 15-day comment period (Adobe PDF, 43 KB) was mailed (e-mailed) to interested parties on September 15, 2006. The comment period ended on October 3, 2006. Board staff was only required to respond to comments related to the newly proposed changes for the second 15-day comment period. Proposed changes appear in the September 2006 proposed text (Adobe PDF, 42 KB), form CIWMB 303a (Adobe PDF, 55 KB), and form CIWMB 303b (Adobe PDF, 31 KB).

Rulemaking History

At its February 18, 2004 meeting, the Board discussed revising form CIWMB 303 and directed staff to formally notice revised regulations for a 45-day comment period.

The package containing proposed regulatory language, Initial Statement of Reasons, and the Notice of Proposed Rulemaking was submitted to the Office of Administrative Law (OAL) for publication of the notice on June 2, 2006. The date of publication began a formal 45-day comment period.

The proposed regulations were sent out for public comment on June 2, 2006, and a public hearing for the proposed regulations was held on July 24, 2006. Comments were received during the comment period, but no comments were received at the public hearing. Based on comments and staff input, further changes were proposed for forms CIWMB 303a and 303b and the associated regulations.

A notice of a 15-day comment period was mailed (e-mailed) to interested parties on August 17, 2006. The comment period ended on September 1, 2006. One comment letter was received.

At the CIWMB Special Waste Committee Meeting on September 7, 2006, the Committee directed staff to make further changes to forms CIWMB 303a and 303b and the associated regulatory text, and to notice the changes for a second 15-day comment period.
