Waste Tire Facility Enforcement

Description

CalRecycle proposes to revise regulations to expand the streamlined penalty program to include tire facility violations and clarify enforcement penalty criteria.

Affected Regulatory Code Sections

California Code of Regulations, Title 14, Division 7, Chapter 6, Article 3.5 (commencing with section 18429).

Status

A 30-day informal public comment period will begin on February 7, 2011 and end on March 9, 2011. A workshop is scheduled for February 15, 2011 to discuss the proposed revisions to this draft regulation. The focus of this public comment period is to address the addition of Excluded and Exempt Waste Tire Facilities to CCR, Title 14, Division 7, Chapter 6, Article 3.5, section 18429.

Rulemaking History

On April 26, 2010, the proposed text was posted on the CalRecycle Web site for public access and review. A Waste Tire Program Review and Informal Regulation Development Workshop was held on May 3, 2010 to discuss informal draft regulation text.

On June 30, 2010, CalRecycle concluded a public comment period on the first draft of the proposed text. On July 12, 2010, at the Waste Compliance and Mitigation Program public meeting a status update on comments received and next steps was presented.
