Waste Tire Storage, Disposal, and Permitting

Description

Existing CalRecycle waste tire storage and disposal standards in Title 14, State Minimum Standards (SMS) are not consistent with the State Fire Marshal’s new fire regulations applicable to waste tire facilities. CalRecycle staff have been directed to revise applicable SMS to comply with the new fire code provisions that went into effect on January 1, 2011. As part of this rulemaking, CalRecycle staff will also draft/propose consistent, enforceable tire regulations changes to:

  • Waste tire facility permit requirements to allow 5-year permit reviews; and
  • Manifest Forms maintenance requirements applicable to exempt common carriers that deliver waste tires to port terminals.

California Code of Regulations, Title 14, Division 7, Chapter 3, Article 4.1 (commencing with section 17225.701), Article 5.5. (sections 17350 through 17356); Chapter 6, Articl3 2 (sections 18423, 18426, and 18427); Article 4 (section 18431) and Article 8.5 (sections 18450, 18456.4, 18459.3, 18460.1.1, 18460.2, and 18461).

Status

The Third Draft Informal Tire Regulations Revisions (PDF, 5.1 MB, which contain the proposed regulations changes including the State Fire Marshal’s new fire regulations, will be discussed at CalRecycle’s public workshop (PDF, 151 KB) on June 21, 2011. A third informal 30-day comment period will run from June 15, 2011 through July 15, 2011.

The first draft informal text containing proposed regulations changes including the State Fire Marshal’s new fire regulations was presented to the public during the Waste Compliance and Mitigation Program’s Monthly Public Meeting held on July 12, 2010. An informal 30-day comment period ran from July 12 through August 12, 2010. Proposed Modifications of Existing Waste Tire Storage/Permitting Requirements (PDF, 1.4 MB) aimed at providing statewide consistency in temporary increases in permitted capacity for waste tires and PDWT were also discussed at this workshop.

The Second Draft Informal Tire Regulations Revisions (PDF, 240 KB,) which contains the proposed regulations changes including the State Fire Marshal’s new fire regulations, was discussed at CalRecycle’s public workshop (PDF, 138 KB) on February 15, 2011. An informal 30-day comment period ran from February 7, 2011 through March 9, 2011. The issue paper Exclusion of Temporary Increases in Permitted Capacity for Products Derived from Waste Tires as Part of the Proposed Waste Tire Storage/Permitting Rulemaking (PDF, 32 KB) was discussed at the meeting.
