Proposed Regulations (Rulemaking)

Rulemaking efforts currently underway are listed below. You will find more detail on the subject and status of individual rulemaking projects at these individual sites, links to the text of proposed regulations and other rulemaking documents, and information about how to comment.

• Short-Lived Climate Pollutants (SLCP): Organic Waste Methane Emissions Reductions. CalRecycle held its first informal stakeholder workshop in February 2017, in Sacramento and Southern California.
• Transfer/Processing: Secondary Material Processing Facilities and Operations. CalRecycle will hold a workshop on March 15, 2017 at 1001 I Street, Sacramento, CA (Byron Sher Auditorium) to discuss an informal draft of the proposed regulations.
• Electronic Waste: Proposed Regulations Amending the Electronic Waste Recycling Program. The proposed regulations serve to finalize two current emergency rule packages as well as modify and clarify other rules within the covered electronic waste (CEW) recovery and recycling program.
• Recycling and Disposal Facility Reporting. CalRecycle will hold another round of workshops in Sacramento and Southern California in December. Draft regulations are available for review.
• Procedural Rules for Conducting Hearings. A Notice of Proposed Rulemaking is expected late in 2016.
• Tire Brokers. CalRecycle has held two informal workshops, March 4, 2015 and March 15, 2016, and will review comments provided to determine the next steps.
• Waste Tire Collection Locations. An informal workshop was held on March 15, 2016 to explain and obtain stakeholder input. Proposed draft regulations are available for review.
• Used Oil. A formal comment period ran from July 11-26, 2016.

Office of Administrative Law (OAL)
The Office of Administrative Law (OAL) is responsible for reviewing administrative regulations proposed by all State agencies and for publishing regulations in the California Code of Regulations. OAL has developed an overview of the rulemaking process which requires state agency's to meet certain public hearing and noticing requirements.

Review of Regulations. Executive Order S-2-03 required that California agencies and departments review pending regulations, as well as regulations adopted since 1999, to assure that the impacts on businesses were adequately assessed. CalRecycle's reports were approved on February 11, 2004.
