Subject:    PhRMA, GPhA, and BIO appeal ruling in favor of Alameda County

The Pharmaceutical Research and Manufacturers Association of America (PhRMA), the Generic Pharmaceutical Association (GPhA), and the Biotechnology Industry Organization (BIO) appealed the August 28 U.S. District court ruling in favor of Alameda County's Safe Drug Disposal ordinance on September 12, 2013 in the U.S. Court of Appeals for the Ninth Circuit.  Although these dates can be altered by court order, the next steps for the appeal are:

        December 23, 2013: Industry’s opening brief is due.

        January 21, 2014: Alameda’s answering brief is due.

        February 4, 2014: Industry’s reply brief due (optional)

Alameda County’s next actions for the Safe Drug Disposal Ordinance are:

        October 8, 2013: Public hearing to consider amendments to the Safe Drug Disposal Regulations

        May 1, 2014: Proposed date that producer plans would be due (from the existing November 1, 2013 date)
