Item Name Item Description
Enforcement (P&I)
Action # A sequential number automatically assigned by the computer system.
Comments Any additional comments that Board staff want to add.
Compliance Dates Date of compliance. Original=Date the original timeline was given by EA/CIWMB to correct the violation. Required=The date or dates that the specific detail line(s) [regulation or statute section(s) ] are required to be in compliance. [Taken directly from the issued (executed) document]. For a Notice of Intent to List it would be 90-days from the date the operator receives a letter from the Board. For all other enforcement actions, it would be the date the EA sets in their enforcement order. Actual=Date the EA/CIWMB states the violation is corrected.
EA Enforcement Agency. Automatically assigned by the computer.
EA Action # EA’s may have their own internal action number, normally stated on the front page of an enforcement action.
Enforcement Action Type Defines type of enforcement action taken. See drop down box: "Administrative Hearing" (Tires): "Cleanup and Abatement Order" (Tires); "Criminal Complaint (Tires)" " Listed" (Those facilities that have been identified on the Inventory of Facilities Violating State Minimum Standards. The Board is required to publish this Inventory by statute. (30 PRC § 44104); "Notice and Order" (An order issued by the EA in accordance with 14 CCR § 18304. An order generally requires the operator to do something by a certain time or face civil or administrative penalities or subject the permit to be suspended revoked or cease operations. ); "Notice of Intent to List" (A enforcement action which gives the operator of a solid waste facility 90-days to correct or face placement on the Inventory of Facilities Violating State Minimum Standards); "Notice of Violation" (Financial Assurances); "Stipulated Notice and Order" (An order issued by the EA in accordance with 14 CCR § 18304. This order is generally signed by the solid waste facility operator.). Stipulated Agreements (An enforceable document issued by the LEA pursuant to 14 CCR 17211 et seq)
Entry Date First date this screen was created.
Final Compliance The date the EA/CIWMB withdraws the enforcement action(s).
Final Compliance Date The date upon which all of the (one or more) cited required compliance date(s) have actual compliance date reported and input into the data base. The final compliance date is the last actual compliance date (chronologically). The date the EA/CIWMB withdraws the enforcement action(s).
Issued On Date the enforcement action is issued by the EA/CIWMB
Last Change Last date any changes were made to this screen.
Original Compliance Date Each Enforcement Action Detail line (Section Number and name) must have an Original Compliance date. If this is the first time a specific section number(s) is cited, then the issue date of the original enforcement action record is the original compliance date. If there is a history of repeated citing of a given regulation number (for two or more enforcement action records), then the first citation date (original date) for a given section number cited repeatedly is the continuing Original Compliance date. (example: if a given section number is cited in a ongoing set of actions such as NOI, listed, NAO, superseding NAO, or a series of NAO each containing the same section number or numbers, then the original compliance date (the original Enforcement action issue date) is the original compliance date for that repeated and cited regulation or statute. Preceding Action # If this was a superseded action, it will have a previous action number for the same violation. For example "Listed' should always have a preceding action number from a 'Notice of Intent to List'.
Program Identifies the Agency issuing the enforcement action. See Drop Down Box: "Closure"(CIWMB Closure Section) " EA" (Identified jurisdictions where the Board acts as the EA); "Financial Assurances"; (CIWMB Financial Assurances Section) "LEA Local Enforcement Agency"; (Local Enforcement Agency) "State" (California Integrated Waste Management Board); "Tire" (CIWMB Tire Unit)
Regulation/Statute Section number and name of the regulation or statute derived from 14 CCR or 27 CCR or 30 PRC.
Required Action Action specifically asked of the operator by the EA/CIWMB.
Required Compliance For a Notice of Intent to List it would be 90-days from the date the operator receives a letter from the Board. For all other enforcement actions, it would be the date the EA sets in their enforcement order.
Required Compliance Date Each enforcement action record may have one or more statutory or regulatory section number(s) cited for compliance. There may be one or more required compliance dates. As the actual compliance date(s) are reported and input into the data base for each section cited, the scheduled compliance date will be changed to the next (chronological) required compliance date.
Scheduled Compliance Date The most current detailed line (chronological) date [the required compliance date that is first due that does not have an actual compliance date yet). Each Enforcement Action Record has one or more detail lines and each detail line has a Required Compliance date and will have an Actual Compliance Date. The Scheduled Compliance date (in the Enforcement Action screen) is the first date due of the required compliance date(s) that does not yet have an Actual Compliance Date in the Enforcement Action Detail box.
Status Automatically assigned by the computer. Will show “superseded” if it was superceded by another enforcement action for the same violation. Will show “complete” if there is a final compliance date completed, otherwise is should show “active”.
Succeeding Action # If this order was succeeded by a new enforcement action, for the same violation, then the data entry user will place the new action number in this block.
SWIS # A unique identification number assigned to a specific facility, site or operation. It comprises eight characters and is divided into three parts having the form "XX-YY-ZZZZ". The first two characters are numbers that represent the County in which the facility is located. The second two are alpha characters and is a code used by a particular LEA or Board Program. The last four characters are numbers generated by the database.
Unit # A unit number is an arbitrary but unique number assigned to a unit for a specific facility.
User Name of person who made the last change to this screen.
