Addendum

Purpose

The purpose of an addendum is to make minor technical changes or additions to an adopted ND or a certified EIR. An addendum can only be used if none of the conditions that would trigger a subsequent environmental impact report or negative declaration is present.

Thresholds or Triggers

Conditions triggering a subsequent EIR or ND are the following:

  • Substantial changes are proposed in the project which will require major revisions of the previous EIR or ND due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects.
  • Substantial changes occur with respect to the circumstances under which the project is undertaken which will require major revisions of the previous EIR or ND due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects.
  • New information of substantial importance, which was not known and could not have been known with the exercise of reasonable diligence at the time the previous EIR, was certified or the ND was adopted, shows any of the following:
    • The project will have any significant effects not discussed in the previous EIR or negative declaration.
    • Significant effects previously examined will be substantially more severe than shown in the previous EIR or ND.
    • Mitigation measures or alternatives previously found not to be feasible would in fact be feasible and would substantially reduce one or more significant effects of the project, but the proponents decline to adopt the mitigation measure or alternative.
    • Mitigation measures or alternatives that are considerably different from those analyzed in the previous EIR or ND would substantially reduce one or more significant effects on the environment, but the project proponents decline to adopt the mitigation measure or alternative.

Preparation and Circulation

The preparation of an addendum by a responsible agency is appropriate where, between the time a lead agency certifies an EIR or adopts a ND and the time the responsible agency is ready to act, some changes or additions are necessary to the EIR or the ND.

An addendum is not required to be circulated for public review but can be included in or attached to the certified EIR or adopted ND. The decision making body shall consider the addendum with the certified EIR or adopted ND before making a decision on the project.

The lead agency shall determine whether to prepare a subsequent EIR or negative declaration, an addendum or no further documentation.

What is an Addendum?

An addendum is a brief explanation supported by substantial evidence justifying the decision of the lead agency. A brief explanation of the decision not to prepare a subsequent EIR or ND should be included in the addendum or elsewhere in the record.

Elements of an Addendum

The addendum should contain the following information but should not supply extensive detail beyond that needed for evaluation and review.

  • Subject
  • Project description
  • Summary
