Recirculation of an Environmental Document

Recirculation of a ND is not required under the following circumstances:

  • Mitigation measures are replaced with equal or more effective measures.
  • New project revisions are added in response to comments on the project’s effects identified in the proposed ND which are not new avoidable significant impacts.
  • Measures or conditions of project approval are added after circulation of the proposed negative declaration which are not required by CEQA, which do not create new potentially significant environmental impacts, and are not necessary to mitigate an avoidable significant environmental impact.
  • New information is added to the ND which merely clarifies, amplifies, or makes insignificant modifications to the ND that does not affect the impact analyses and the environmental determination and subsequent findings of the negative declaration.
