Disposal Reporting System

Compliance with DRS Regulations

The Disposal Reporting System (DRS) requires facilities, haulers, and agencies (counties/jurisdictions/districts) to follow certain reporting criteria. All entities are required to submit their reports on or before the deadline each quarter, and report accurately. Failure to do so can lead to reprimand procedures, as outlined in the regulations. The following excerpt details CalRecycle’s procedure for dealing with DRS compliance issues, and actions that may be taken against noncompliant parties (haulers, facilities, agencies).

Title 14, California Code of Regulations (CCR), Sections 18804.4 and 18804.5:

(4) CalRecycle staff shall work with affected parties to investigate and attempt to resolve allegations of noncompliance, including allowing the entity accused of noncompliance a reasonable opportunity to provide relevant information regarding the allegations. If CalRecycle staff substantiates the allegations and cannot resolve them, then CalRecycle shall make a determination on the allegations of noncompliance at a public meeting. Based on a finding of noncompliance, CalRecycle may take one or more of the following actions:

(A) notify the affected jurisdictions of CalRecycle's finding of noncompliance,
(B) publish the name of the hauler or operator and the finding of noncompliance for a three-year period, using electronic or print media, or
(C) other actions as CalRecycle deems necessary.

(5) If CalRecycle, based on its own investigation, determines that a hauler, operator, jurisdiction, agency, or district is not complying with the requirements of this Article, CalRecycle may take one of the following actions:

(A) notify the affected jurisdictions of the CalRecycle's finding of noncompliance,
(B) publish the name of the hauler or operator and the finding of noncompliance for a three-year period, using electronic or print media, or
(C) other actions as CalRecycle deems necessary
