This electronic newsletter is an update on the implementation of California's Electronic Waste Recycling Act of 2003 (Act) and other electronic waste (e-waste) management developments in California.

#### Urgent Advisory: DLP Video Displays Are NOT CED/CEW ####


The California Department of Resources Recycling and Recovery (CalRecycle) is issuing this urgent advisory to all covered electronic waste collectors and recyclers, as well as other interested parties, reminding all that digital light processing (DLP) video displays currently are NOT covered electronic devices (CED) and therefore are not covered electronic waste (CEW) when discarded.  DLP displays are considered universal waste electronic devices when discarded if managed compliantly.


This is not a new determination.  However CalRecycle has recently received numerous inquiries, which prompted this advisory.  Affected parties must note that only CED is subject to the covered electronic waste recycling fee and only CEW is eligible to be managed within the recovery and recycling payment system.


Pursuant to the Electronic Waste Recycling Act of 2003, the Department of Toxic Substances Control (DTSC) has the authority and responsibility to determine what constitutes a CED in alignment with specific criteria. 


The general definition of a CED can be found in:


Public Resources Code section 42463(e)


The authority for DTSC to further clarify what is a CED can be found in:


Health and Safety Code section 25214.10.1


The regulation that delineates the current list of CED can be found in:
